Rule #1

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern online sales of games, consoles, accessories, guides, merchandise, DLC/subscriptions, and other digital content or services (hereinafter referred to as the "Product(s)"), concluded between, on the one hand, any legally competent adult consumer residing in Metropolitan France, including Corsica (hereinafter referred to as the "Customer(s)"), and the company Maurel David (hereinafter referred to as "MAUREL DAVID"), on the website https://carrefourdusex.fr (hereinafter referred to as the "Website"). These GTC, as well as all information relating to the Products mentioned on the Website, are written in French. These GTC apply to the exclusion of all other terms and conditions, including those applicable to in-store sales. These General Terms and Conditions of Sale (GTC), together with the online order confirmation, constitute the contractual documents binding on the parties, to the exclusion of all other documents, brochures, catalogs, or photographs of the Products, which are for illustrative purposes only. The GTC are available to the Customer on the Website, where they can be directly consulted. They are binding on the Customer, who acknowledges, by checking the box provided for this purpose, having read and accepted them before placing an order. Order validation by confirmation constitutes acceptance by the Customer of the GTC in effect on the date of the order, which are stored and can be reproduced by MAUREL DAVID. MAUREL DAVID may modify certain provisions of its GTC. It is the Customer's responsibility to review any modifications before placing an order. These modifications are binding from the date they are published online and cannot apply to contracts concluded prior to that date. Each purchase on the Site is therefore governed by the Terms and Conditions in effect at the time the order is placed, a dated copy of which can be provided to the Customer upon request. Should any clause of these Terms and Conditions be declared null and void, the other clauses shall nevertheless remain in full force and effect. All commercial transactions offered on the Site are valid only for Products sold or supplied on the Site.

All personal data is protected and encrypted by an SSL certificate, providing you with optimal data and transaction protection.

Rule #2

2.1 - Product offers on the Site are governed by these terms and conditions and are valid as long as they remain online. Customers are advised to check product availability on each product's information page. Products are offered and delivered subject to availability. If a product ordered is unavailable, Maurel David will immediately inform the Customer and may offer a product of equivalent quality and price. Orders cannot be cancelled. To return a defective item, you have 14 days to send it to us. In the event of order cancellation, you have a 14-day cooling-off period to decide.

2.2 - The Products offered for sale comply with current French legislation.

 

2.3 – Each Product offered for sale on the Site is accompanied by a description outlining its essential characteristics as defined by the French Consumer Code. The Products offered are described as accurately as possible. Photos, texts, and drawings associated with the Products presented, transmitted and sometimes modified without notice by the suppliers from whom they are purchased, are for illustrative purposes only. MAUREL DAVID will make every effort to ensure that these elements are as faithful as possible to the Products delivered or supplied to the Customers. However, despite MAUREL DAVID 's vigilance , minor differences may exist between the product and the final product delivered to the Customer.

 

Rule #3

3.1- Commands

Before finalizing their order, the Customer has access, in a legible and understandable manner: Information relating to the essential characteristics of the Products ordered and their price; The details of the order; The conditions, time limit and procedures for exercising the right of withdrawal mentioned in Article 6 of the General Terms and Conditions, as well as the standard withdrawal form appearing in ANNEX 1 of the General Terms and Conditions; The procedures surrounding the costs of returning the Products in the event of exercising the right of withdrawal.

 

3.2 - Ordering Process

 

Product Selection: The Customer selects the Product(s) they wish to order;

Verification of the selection content: The Customer checks the contents of their basket while retaining the option to remove the selected Product(s);

Identification: The Customer completes the identification form provided and enters the requested information (mandatory information: last name, first name, email address, postal address, telephone number, password). By validating the creation of their account, the Customer acknowledges and accepts the Terms and Conditions, and then agrees or declines to receive email alerts (to be kept informed by email of product availability or news of interest to the Customer), newsletters, and MAUREL DAVID information . The Customer can unsubscribe from this service at any time from their account.

Order verification: The Customer checks the contents of their order, the total price, the delivery and billing address, while retaining the option to delete a Product or modify the billing and delivery address;

Delivery Options: The Customer may choose between: - delivery via So Colissimo, Chronopost, or France Express, to the address they provide or to a MAUREL DAVID partner retailer selected from the list available on the Website, - in-store pickup of the Products at the MAUREL DAVID store of their choice. Before making their selection, the Customer is informed of the delivery costs associated with each option. The Customer confirms their delivery choice by selecting the desired delivery option and clicking the "Validate Cart" button. The Customer then confirms their delivery choice on the following page by clicking the "Continue" button.

Choice of payment method: The Customer chooses the payment method according to the terms defined in article 4 of the General Terms and Conditions.

Order confirmation: after reviewing the Terms and Conditions, the Customer confirms their order after checking it by clicking on the "Order and pay" button.

Payment: The Customer proceeds to pay for their order according to the payment method chosen by them.

Order acknowledgement: The Customer receives an email summarizing the contents of their order, namely: Their order number; The bank transaction number; The list and price of the Products ordered; The delivery terms and price;

This document serves as the official order confirmation, and the Customer must retain it, particularly to exercise their right of withdrawal when applicable. The Customer has access to all the necessary legal information, which is contained in the following two documents: the order summary email, which the Customer can print at any time; and the applicable Terms and Conditions at the time of the order, which will be attached to the order summary email.

 

Order Processing: MAUREL DAVID undertakes to fulfill orders registered on the Website and validated by PAYPAL (transaction analysis system). If an item is not immediately available, MAUREL DAVID will inform the Customer as soon as possible by email or telephone. MAUREL DAVID reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute concerning payment for a previous order. MAUREL DAVID is a retailer and does not intend to sell the Products offered in large quantities. For this reason, any Customer request that appears abnormal or is made in bad faith may be refused by MAUREL DAVID. In the event of order cancellation, the Customer will be refunded within a maximum of fourteen (14) days from the date of their refund request, submitted in accordance with the provisions of Article 6 of the General Terms and Conditions of Sale.

The Customer will receive an email confirming the shipment of their order. The contract is deemed to be concluded on the date this email is sent.

Product Pre-order

 

In certain cases, the Customer may pre-order a Product on the Website that is not yet available for sale in order to reserve it for its official release date. The Product will then be delivered to the Customer according to the delivery method chosen by the Customer, under the conditions set forth in Article 5 of the General Terms and Conditions of Sale. If, in very exceptional circumstances, the pre-order cannot be fulfilled by MAUREL DAVID , the Customer will be fully refunded the amount paid, by bank transfer and at no additional cost to the Customer. The stock arrival date provided by the publisher of a Product is only indicative; therefore, MAUREL DAVID cannot be held liable for any delay compared to the date initially communicated to the Customer.
